Contextual Ads and Pictures

I’ve lost track of what’s the current feeling on this issue. Last I remember YPN didn’t like it Adsense wanted a line separating the pics and the adverts. If I’m way off base could some one point me in the direction of a forum thread from a reliable person I’d appreciate it.

At SES is San Jose, I asked Kim Malone, the Director of Operations for AdSense about the issue of blending ads into the content of a page via thumbnail photos and other formatting tricks and techniques to help improve the CTR during the PPC Arbitrage session. Kim said that Google doesn’t police those types of issues.
Other people on the panel jumped in right away and said that the program would turn into the “Gong Show” if Google started to create policies about page style and formatting limitations, etc. Kim seemed to agree about the potential problems with webmaster relations and the basic logistical problems with enforcing style guidelines.
… and then volunteered something that I didn’t entirely understand about using AdWords conversion tracking data to help with that sort of thing. (???) This comment set off a new and heated conversation but Kim didn’t elaborate how they are using the conversion data.

“be interesting to know what percentage of advertisers actually use conversion tracking, and what subset use it they way GOOGLE intended … wooops did I just say that …”
Any thoughts from you?
Is this system designed to punish publishers who have an above average click-through-rate on AdSense by reducing their % payout?

He received an email from Adsense that said this:
Publishers are not permitted to encourage users to click on Google ads or bring excessive attention to ad units. For example, your site cannot contain phrases such as “click the ads,” “support our sponsors,” “visit these recommended links,” or other similar language that could apply to the Google ads on your site. Publishers may not use arrows or other symbols to direct attention to the ads on their sites, and publishers may not label the Google ads with text other than “sponsored links” or “advertisements.”
